General terms and conditions of business

1. Scope

These General Terms and Conditions (GTC) apply to all services provided by the Stickler Boat Driving School / bootfahrenlernen-berlin. Courses and services are conducted exclusively under the following conditions. All verbal agreements and declarations only become part of the contract if they are agreed upon in writing or confirmed by us in writing.


2. Contracting parties

3. Offer and conclusion of contract

The service provider offers courses as well as individual driving lessons and training sessions in the areas of sailing and motorboating.

Customers are bound by the terms and conditions in the contract from the moment a contract is concluded.


4. Cancellation 4.1 According to § 312g No. 9 BGB and § 312g No. 1 BGB, there is no possibility of cancellation with regard to our services or the sale of our vouchers.


4.2 If a participant does not complete a course or fails/does not register for the exam, there is no possibility of revoking the service or refunding the course fee.



5. Cancellation: Participants may cancel free of charge up to 7 days before the course begins. From 6 to 2 days before the course begins, a fee of 40% will be charged, and for cancellations less than 24 hours before the course begins, 100% of the total price will be charged unless a replacement participant can be found under the same conditions.

6. Prizes

All prices are final prices including VAT.


7. Payment

Payment of the agreed course fee is made in cash or by bank transfer. Participants must pay the fee by bank transfer or in cash by the first session. Otherwise, the course provider reserves the right to pause or cancel the course. For bank transfers, the decisive factor is the date the funds are credited to the provider's account, at the latest on the day the course begins.


8. Sailing courses

The course fee includes all necessary practical sessions until you are ready for the SBF exam. Participants are required to attend a minimum of 6 sessions, unless fewer are requested. The maximum is 15 sessions. Practice sessions are also included to prepare for a retake exam. Theory materials are not included.


A practical sailing session typically lasts 2.5 to 3 hours. Shorter sessions due to time constraints on the part of the participant do not entitle the participant to a make-up session at another time. The service provider reserves the right to refuse sailing sessions shorter than 2 hours if the effort involved (travel and preparing the boat) is deemed disproportionate. All sessions must be arranged with the service provider.


9. Motorboat courses

The course fee includes the necessary practical training sessions to pass the SBF motorboat exam. A minimum of 3 sessions and a maximum of 12 sessions are required. Practice sessions are also included to prepare for a retake exam. Theory courses and materials are not included.


A practical engine training session typically lasts 1 to 1.5 hours. Shorter sessions due to time constraints on the part of the participant do not entitle the participant to a make-up session at another time. The service provider reserves the right to refuse engine training sessions shorter than 1 hour if the effort involved (travel and preparing the vessel) is deemed disproportionate. All sessions must be arranged with the service provider.


10. Theory courses

The course fee includes the theory sessions specified in the course description. Each session lasts approximately 2.5 hours. Theory learning materials such as a textbook are not included.


All appointments must be arranged with the service provider. If a participant is unable to attend a course, the service provider must be informed in advance.


Theory sessions take place either in person in a classroom or on a boat. In the event of government-imposed COVID-19 restrictions, the courses may also be offered online by the service provider via Zoom or similar platforms.


11. Shortening of appointment time

Shortening or cancellation of a course due to bad weather such as thunderstorms, heavy rain, storms or gusts of wind or calms, or due to lack of time on the part of the service provider, entitles the course participant to make up the course time free of charge on another date, provided that this is possible before the exam and according to the weather.


12. Appointment cancellation and liability

12.1 The service provider is not liable for daily or longer cancellations of sessions caused by extended periods of bad weather, calm weather, damage to the training boat, flooding, or closure of the jetty (by the lessor). This also applies to cancellations due to natural disasters, wars, epidemics, and government orders and laws. The course can then be continued at the next available date without additional charges.


12.2 The service provider is not liable for missed appointments and their financial consequences caused by the course participant, if this results in an insufficient number of appointments being available to prepare for the registered exam. The service provider may offer alternative dates, but if these are no longer possible due to the exam date or the end of the season, or if the course participant cannot attend them, the course participant bears all consequences.


12.3

No sailing practice sessions will take place between November 1st and May 1st, as safe instruction is not possible due to weather and water temperature.

13. Official SBF examination

13.1 The course participant is obligated to register for the SBF (Sportbootführerschein - German boating license) examination upon the service provider's recommendation. The examination date must be arranged with the service provider so that they can be present with the training boat. The service provider is not liable in the event of the training boat's unavailability on the examination day. In this case, the service provider will attempt to provide an equivalent boat on the agreed examination date, but there is no entitlement to this.

13.2 The service provider cannot guarantee or influence the passing of the SBF examination by the external examination board. It is not liable for retake fees. If a course participant fails the examination, they are entitled to free practice sessions to prepare for the retake. These practice sessions are included in the course price.

 

13.3 The service provider is not liable if the course participant fails to register for the SBF examination in a timely manner, fails to submit their documents, or fails to pay their examination fee. The course participant is responsible for these matters and must resolve them independently with the examination board.

 

14. No-show

If a course participant fails to attend three scheduled practice sessions without canceling at least three hours in advance, a €30 travel fee will be charged. The course will only resume after this fee has been paid.

 

15. House Rules

The participant agrees to be on the premises of ATV Arminia Cheruscia e.V., including the sanitary facilities and the jetty, solely for the purpose of boarding and disembarking the boat, and to use the designated paths (yellow path). Other areas of the property and building may not be entered. Loitering on the jetty, in the sanitary facilities, or on the property is not permitted. Swimming at the jetty or on the shore of the ATV property is prohibited, as is the use of and access to the floating dock for rowing boats.


16. Termination by the service provider

The service provider is entitled to terminate the contract if unforeseen circumstances arise, such as force majeure (e.g., strong winds, lightning, hail, or other unforeseen exceptional events), damage to the boats due to collisions, war, theft, or vandalism, official prohibitions, or federal orders, which prevent the planned service from being performed as usual. In this case, the customer will receive a pro-rata refund of the total price for the services not rendered. No further claims for compensation exist.


17. Valuables

The service provider is not liable for the safety of personal belongings (watches, glasses, cameras, mobile phones, etc.) taken on board the training ships or to the training area and jetty.


18. Final Provisions

The customer expressly accepts the service provider's terms and conditions with their signature. The place of performance for this contract and the place of jurisdiction for Stickler Boat Driving School is Berlin, and the statutory provisions apply. German law applies exclusively. For persons whose residence or habitual abode is abroad, or whose residence or habitual abode is unknown at the time legal action is initiated, the place of jurisdiction is Berlin. The contract is valid when the course participant has received a signed copy. Should any provision of this contract be invalid, the remaining provisions shall remain in effect. Verbal agreements require written confirmation. Statements and information are provided to the best of our knowledge, but without guarantee.
